RECOMMENDED ACTION

City Council accept the resignation of Carl K. Newton as City Attorney, to be effective

January 1, 2011, and authorize the City Manager to execute amendment to the Agreement for City Attorney Service, dated January 1, 2005, between the City and Burke, Williams & Sorensen, to designate Joseph M. Montes as City Attorney, effective January 1, 2011.

BACKGROUND

Upon the completion of twenty-three years of service as City Attorney by Carl K.

Newton, he has elected to retire from the full-time practice of law as of January 1, 2011.

Mr. Newton will still be available at Burke, Williams & Sorensen to work on special

assignments and for consultation on behalf of the City on an as-needed basis. Joseph M. Montes, who currently serves as Assistant City Attorney, by way of an amendment to the Agreement for City Attorney Service, dated January 1, 2005, between the City of Santa Clarita and the law firm of Burke, Williams & Sorensen, shall be appointed City Attorney, effective January 1, 2011. The City Manager is hereby authorized to execute an amendment to said agreement designating Joseph M. Montes as City Attorney, effective January 1, 2011. All other terms and conditions of said Agreement for City Attorney Service, dated January 1, 2005, shall remain in full force and effect.
